Whereas the construction of the European unity is based in a large part on
the Community legal system, it does not preclude substantial borrowings
from international public law. This twofold approach outlined in the basic
treaties and institutionalized in the Single European Act was made constitutional
in the European Union Treaty’s distinction between the « community
pilar » and governmental cooperation. This distinction entails
many limitations, interactions and alterations. In the light of this dual
aspect, the author analyzes the Schengen Agreements, their origin, and their
possible future with regards to the various dispositions dealing with cooperation
in the fields of legal and internal affairs.
