Territorial decentralization implies administrative decentralization, i.e.
the transfer of competence from the state to the districts, and financial
decentralization, i.e. the immediate and total compensation for the
financial burden on the district budget implied by the transfer of competence.
However, whereas administrative decentralization, as measured
by the system of transfer of competence and the nature of transfered
competences, has been real, financial decentralization has been
insufficient as illustrated by the limited control of the districts on fiscal
resources and the important share of the state’s financial contributions.
Given the obstacles raised by the law and the decision of the Conseil
constitutionnel, a solution to this contradiction implies a new revision
of the 1958 Constitution.
