Jean-Jacques HEINTZ, Hafida LAHIOUEL - International Crime Tribunal for the ex-Yougoslavia : Problems and Success

Established on May 25, 1993 and November 8, 1994 respectively, the
International Crime Tribunals for the ex-Yougoslavia and for Rwanda
have existed for five and six years. What lessons may be drawn from
these years during which many hurdles have appeared and have been
partly overcome ? The authors recall some of the practical and judicial
problems that have marked the first years of existence of these jurisdictions,
in particular the ICTY. The problems linked to the cooperation
of the states and the competence ratione materiae have been more
difficult to solve.
