The requirement of secrecy in the field of National Defense has always
served different goals from those officially proclaimed. With a concern
for conciliating the rule law and the necessary secrecy of National
Defense, the Jospin government decided to create a commission on
National Defense secrecy in 1998. The role of this commission is to give
an opinion on the declassification and communication of information
classified under the provision of article 413.9 of the Penal Code. It is the
first independent agency with open access to the National Defense
secrets. It facilitates the supervisory role of the French parliament’s
investigation commissions and of the officials in charge of controlling
the budget of civil and military civil servants.
