The appearance of two ministers and a former Prime minister in front
of the Court of Justice of the Republic in the contaminated blood case
is a good example of the end of the legal extra-territoriality of the rulers
and of the accelaration of the judicial penalization of French society.
Instead of looking for a way to protect political leaders from a system
that seems out of control, it would be better to look for ways to modernize
seriously our procedures and judicial institutions in the general
interest. Nevertheless, the judicial evolution forces us to renew our traditional
jacobinic understanding of the separation of powers.
