The European Courts’ jurisprudence is having considerable consequences.
The French courts apply their decisions. However this alignment
may be slow and reluctant. Today, there remains a disagreement
between the French courts and the ECJ on the legal basis establishing
the primacy of community law over French law. French courts are
bound by the decisions of the European Court of Justice through the
mechanism of prejudged questions whose consequences have been and
continue to be essential.
