Pierre FAUCHON - The July 10, 2000 Law After the Mont Blanc Tunnel Judgment
Pouvoirs n°117 - Serviteurs de l’État - avril 2006 - p.71-75
The trial dealing with the Mont Blanc Tunnel accident ended with a judgment
that answered a number of questions raised by the July 2000 law
about non-intentional delinquency. However, it also raised new questions,
regarding in particular the nature of the sentence, the particular
situation of local elected officials, the assessment of the seriousness of the
careless action, the scope of the penal responsibility of public figures.
These questions are discussed in the article in preparation for a debate
to take place in a conference in the Senate on March 1st.
