Olivier DORD - The National Judicial Systems and the European Courts : From Confrontation to Complementarity ?

The author offers a new reading of the relationships between the
European Courts and the national judicial systems. The praetorian
affirmation of the Luxembourg and Strasbourg Courts is rather well
accepted by the member states. Real but limited confrontations, in particular
regarding the role of the constitution, have been overcome
thanks to the community of values shared by European and national
judges. The mutual borrowings and exchanges are forging a new
common law. However, such a complementarity does not prevent the
alteration of the law, the institutions, and the identity of the state
systems.
