The notion of a legal responsibility of the physicians in their professional activity is rapidly being acknowledged. Two aspects of this responsibility are considered here : civil responsibility, which has witnessed major jurisprudential evolutions, and criminal responsibility which tends to be increasingly acknowledged for physicians as for many other professionals. This, however, should not mask the emergence of new mechanisms to repair damages caused by medical treatments as well as the recognition of the physicians’s financial responsibility. Résumé
