Denys SIMON - The Reciprocal Influence Between the ECJ and the ECHR : Love’s Labour Lost ?
Pouvoirs n°96 - Les cours européennes. Luxembourg et Strasbourg - janvier 2001 - p.31-49
The relations between both European Courts of justice have been made
more complex by the uncertainties surrounding the legal status of the
European Court of Human Rights vis-à-vis the Luxemburg Court, as
well as the legal status of European law vis-à-vis the Strasbourg Court.
Their mutual influence, indeed the convergence of their jurisprudence,
the use of common standards, the coherence of their methods of interpretation
of the law, do not suppress all the risks inherent to their
coexistence, in particular given the growing autonomy of the European
system of protection of fundamental rights.
