By giving new responsibilities to local elected officials decentralization
has, at the same time, exposed them to new risks. It is not rare today to
see a mayor taken to court, and sometimes convicted, for non intentional
errors that were in the past considered as mere accidents. Is not this
increased criminal responsibility likely to lead to inaction and discouragement
? The author discusses the causes of this drift and suggests
steps to find a desirable balance between democracy and responsibility.
