Pascal JAN - The constitutional Council
Pouvoirs n°99 - La nouvelle Ve République - novembre 2001 - p.71-86
The growing role of the constitutional judge since the 1970s has greatly
contributed to the protection of fundamental rights and freedoms.
However, the diversity of his attributions and the limits stemming from
the form of his intervention hamper him and check the development of
his jurisprudence. Any reform of his office and of the procedures followed
before him will be conditioned by a redefinition of his competence
focused on the control of norms.
