Local democracy produces and at the same time requires a juridical
function. The latter consists in providing, within the statutory limits
and under the supervision of judges, a set of tools which, under various
forms, aims to institutionalize the participation of citizens to the life of
their district. The survey presented here tries to highlight the political
dimension of this juridical function, by first presenting the various
legal categories and then offering a critical assessment of the way they
operate. In the end, the original experience of districts in France helps
us understand why and how there can be no structuration of a local
public space without some «play» with the juridical constraints and
resources.
