Is Europe a Constraint or a Reinforcement?

The feeling of a relentless erosion of the power of the state at the hand of the European Union has become widespread. It is based on various elements which tend to present eu law as monolithic, and implemented by a centralized power allowed to impose European norms, includling to domains that fall within the sphere of competence of the states’ sovereign powers. Such assertions ignore the complexity and specificity of the European constraint, which varies according to the characteristics and processes of elaboration of a particular law, the nature of the competence granted to the eu or the extension of the derogations accorded to the member states. In the end, the terms of the debate themselves—in particular the notion of “sovereignty”—are being redefined as the state finds in the Union a renewed framework to exercice its power.
