The “judiciarization” of soccer has been criticized recently by certain observers
who fear a litigious drift leading to an excessive recourse to the judge.
However, this phenomenon is not that “new” and is in keeping with the broader
trend which is leading the administrative and judicial judges, as well as the
agencies in charge of monitoring competition, to study the way soccer operates.
The staggering financial stakes are leading the club managers as well as the
players to use all the appeal procedures at their disposal. In this domain, as in
any other, the mission of the judge is to arbitrate between the claims of both
parties by implementing the law. However, the conditions least favourable to
the intervention of the judge, in a climate of great media attention, are precisely
those where the rules of the game are widely accepted and respected.
